Tendero AI - Terms of Service
Introduction
Tendero AI is a public procurement platform operated and owned by SIA Pioneer, a company registered at Kr. Valdemara iela 27/29, LV-1010, Riga, Latvia. By accessing and using Tendero AI, users agree to abide by these Terms & Conditions, which govern the use of both free and paid services offered on the platform.
Definitions
For the purposes of these Terms & Conditions, the following definitions apply:
A User is an individual or entity utilizing Tendero AI under the free plan.
A Customer is an individual or entity that has subscribed to one of Tendero AI's paid AI solutions.
The Platform refers to the Tendero AI service, accessible via Tendero.eu.
The Service refers to the AI-powered monthly subscription plans provided by Tendero AI.
Account Registration & Use
Users can register on Tendero AI using either a business email or Gmail account. There are no age restrictions for registering or using the platform. However, users acknowledge that
AI-generated content may not always be accurate. Tendero AI promotes a “Trust but Verify” policy, encouraging users to validate all information independently.
Users are responsible for securing their accounts, including managing passwords and preventing unauthorized access. If a user wishes to delete their account, they may do so at any time without restriction.
Services & Limitations
Tendero AI provides both free and paid services, detailed as follows:
Free Plan
Users on the free plan have access to:
Public tenders from EU institutions, Czech Republic, Ireland, Romania, and Slovakia.
Semantic keyword search for finding relevant tenders.
Search filters to refine tender searches.
Tender document downloads.
Unlimited subcontractor comments for discussions and networking.
Paid Plans
Tendero AI offers two paid plans:
Tendero Plus (€250/month, 1 user)
Includes all Free Plan features.
Custom alerts to notify users of relevant tenders.
30 AI Tender Reports, including Chatbot insights, Summaries, and Compliance Reports.
Tendero Business (from €400/month, minimum 2 users)
Includes all Tendero Plus features.
50 AI Tender Reports.
Dedicated multichannel support for assistance and troubleshooting.
Limitations of the Service
Tendero AI does not guarantee bid success and should not be considered a substitute for professional legal consultation. While it provides helpful insights, the AI-generated information may not always be accurate. Tendero AI services are available for tenders from EU institutions, Ireland, Czech Republic, Slovakia, and Romania.
User Obligations & Responsibilities
Tendero AI complies with GDPR regulations to ensure user data privacy. Users can reach out to our GDPR compliance officer at [email protected] for any concerns related to data protection.
The following actions are strictly prohibited on the platform:
Scraping content from Tendero AI, as it disrupts the service.
Posting hate speech, offensive language, or unprofessional content in the subcontractor comments section.
Sharing harmful links, malware, or fraudulent content.
Users violating these policies may face content removal, warnings, account suspension, or permanent bans.
Subscription & Billing
Tendero AI operates on a subscription-based model. The billing terms are as follows:
Billing cycle: Your subscription will be billed monthly on the same date it was originally activated.
Subscription renewal: Subscriptions automatically renew unless canceled before the renewal date.
Annual payments: Customers paying annually receive up to 15% discount.
Non-payment: If a customer fails to pay, their account will revert to the free plan with limited access.
Cancellation & Refund Policy:
Monthly subscriptions: If canceled before within the first 5 business days of subscription, the user is eligible for a full refund upon request.
Annual subscriptions: If canceled, no refund will be issued for the unused portion of the subscription. For instance, if a customer cancels three months into an annual plan, they will not receive any refund for the remaining nine months.
Additional Charges: Customers who exceed their AI token limits may purchase extra tokens by contacting their account executive.
Ownership of Generated Content
All AI-generated reports and chatbot outputs created by a paying customer belong to them. Tendero AI does not claim ownership of any user-generated content.
Data Privacy & Confidentiality
Tendero AI is fully GDPR compliant and takes all necessary measures to protect user data. Users can refer to our Privacy Policy for further details on how their data is handled.
Limitation of Liability
Tendero AI is not responsible for errors or issues caused by third-party service providers, including payment processors, hosting providers, or data sources. Any disputes with payment processors must be addressed directly with them.
Additionally, since AI-generated content may sometimes be inaccurate, Tendero AI does not accept liability for any errors in its outputs.
Disclaimer of Warranties & Responsibilities
Tendero AI does not guarantee bidding success or the absolute accuracy of AI-generated insights and therefore the owner SIA Pioneer cannot be held accountable. The AI may produce incorrect or misleading information, and users must verify outputs before making procurement decisions. Tendero AI serves as an informational tool and does not replace professional legal or procurement advice.
Account Termination & Restrictions
Tendero AI reserves the right to suspend or permanently ban accounts for the following reasons:
Violating GDPR compliance requirements.
Posting harmful links, malware, or fraudulent content.
Engaging in offensive, inappropriate, or unprofessional discussions in the subcontractor feature.
Scraping, data collection or mining outside of Tendro API service.
Banned accounts will lose access to both paid and free services. Refunds will not be issued for violations of these terms.
Legal Jurisdiction & Governing Law
Tendero AI is owned and operated by SIA Pioneer, a company registered in Latvia. These Terms & Conditions are governed by Latvian law, and any disputes shall be resolved in the courts of Riga, Latvia.
Amendments to Terms & Conditions
Tendero AI reserves the right to update or modify these Terms & Conditions at any time. Users will be notified via email of any changes, and continued use of the platform signifies acceptance of the new terms.
